Future of America’s oldest steakhouse, Delmonico’s, closed for the last three years in doubt

The future of Delmonico’s, the nation’s oldest steakhouse, which dates back to 1837 until the pandemic, appears to be at stake.

The 186-year-old restaurant, located in the Financial District, also serves as exterior shots of The Continental Hotel in the John Wick film series, and has been closed for nearly three years.

However, there is currently a dispute between two parties who claim they have the right to reopen the restaurant in the Financial District.

The Continental is John Wick’s most iconic location: a hotel for assassins where they can drink scotch and keep an eye on other assassins while they do “business” in the heart of the Financial District.

The dispute is over who owns the rights to Delmonico’s name and its use.

A press release sent out last week said the restaurant would return in the fall of 2023, but an Instagram post on Delmonico’s Instagram account claimed that “recent reports that we will be reopening on Beaver Street are false.”

“It has come to our attention that former associates have misrepresented themselves to the media as the owners of Delmonico’s,” the post said.

One family claims that they have the right to use the trademarked name, while the other side claims that announcing any kind of relaunch is a violation of trademark rights.

The Grgurevs, who once ran the restaurant and currently manage Delmonico’s Instagram account, claim that the new tenants at 56 Beaver Street are using the Delmonico’s name in bad faith, without their involvement and unrelated to the restaurant’s reopening.

Grgurevi is also in the process of filing a lawsuit against the new operators.

The controversy stems from a spring 2021 legal ruling that allowed brothers Ferdo and Omer Grgurev to secure full ownership of the location, but barred them from operating Delmonico’s or any other restaurant within a one-mile radius until March 2023.

However, the Grgures have said they still have the right to still operate the restaurant under the Delmonico name.

Meanwhile, Dennis Turcinovich and Joseph Likul, who are associated with another restaurant, are now claiming to be the new owners of the property as of Jan. 1, 2023, and are not involved in any ongoing lawsuits with the previous owners.

A representative for Turcinovich told Eater how he and Licul signed a new 15-year lease with Time Equities and deny any claims that they are not the rightful owners.

They have announced plans to remove all sites that state otherwise and plan to open new sites if the issue is not resolved.

But the Grgurev brothers point out that it is they who have the right to operate a restaurant with the Delmonico name and others who are prohibited from operating a Delmonico or any other restaurant within a one-mile radius until March of this year.

In April 2022, landlord Time Equities, led by the Grgurev family, attempted to evict the restaurant for alleged nonpayment of nearly $300,000 in rent and fees.

The Grgures family denied the eviction claim and said it was related to the landlord’s delay in repairing water damage caused by Hurricane Ida in 2021.

When the lease expired in December 2022 and was not renewed by the landlord, Time Equities then signed a deal with Turcinovich and Licula, Grgurev’s former partners.

Omer Grgurev’s daughter, Michelle Grgurev, now says her family believes the landlord intentionally let the lease expire so it could be re-issued to new tenants.
